In order to have a better understanding of the mechaverse, these Terms of Use guide your access to the MechaSharks website; use forms an agreement between the entity (“you”) and MechaSharks (“we”, “us” or “our”) regarding your access to www.mechasharks.com. MechaSharks is a game that will run exclusively on the Waves network (the “Blockchain”) where it will be allowed through smart contracts (each, a “Smart Contract”) that users can buy, transfer and battle unique creatures that will be active digital or rather non-fungible tokens (“NFTs”) on our online services (collectively, the “Service”).

PLEASE READ THE TERMS OF USE CAREFULLY AS IT IS IMPORTANT TO BE AWARE OF THE GAME AND YOUR LEGAL RIGHTS.

In cases of additions to terms and conditions or even referring documents that may be published on the website and in Smart Contracts on a regular basis, they will be introduced here by reference. We retain the exclusive right to make changes or modifications to these Terms of Use at any time and for any reason. You will be notified in advance of any changes by updating the "Last Updated" date of these Terms of Use. It is your sole responsibility to constantly observe these Terms of Use to stay informed about. Therefore, you will be deemed to have agreed to and are aware of any future changes to the Terms of Use by the site or Smart Agreements.

2. Intellectual Property Rights

Unless otherwise stated, the entire Service and other tools contained without limitation, including the MechaSharks logo, source code, designs, images, text, graphics, functionality, software, information, data, sound files, photographs and among other files are owned by exclusive property of MechaSharks or licensed by us as applicable and are protected by copyright laws. The MechaSharks logo and among Other names including those on the mechaverse, MechaSharks product or service logos and slogans that may appear on the Service are trademarks of MechaSharks and under no circumstances may be copied or used without our prior written permission.

3. User Settings

By using the Site, you agree that: (1) all of your information is truthful, (2) you will update your information on the Site as necessary, (3) you agree to abide by all of the Terms of Use, (4) ) you will in no way use the Site and Smart Contracts for any illegal and unauthorized purpose, (5) you have no right to any illegal method of data use, bots or similar means of data collection or extraction, (6) any part of the Service or Content may not be downloaded (except caching) as permitted by us and (7) any Service or Content used illegally is prohibited.

4. About User Registration

When registering on our Site, you must keep your password confidential and prevent it from falling into the hands of third parties. Any and all access by you to the Site and the use of your password will be at your own risk. Any username that is inappropriate, obscene or objectionable will be changed or removed by us.

5. Activities Considered Prohibited

You agree that you will not violate any laws relating to the Site and that you are solely responsible for your conduct when accessing or using the Service. By agreeing to the Terms, you accept the following rules:

  • Using the Site or Smart Agreement in an unauthorized manner such as collecting usernames and/or email addresses of users by electronic means or other unsolicited purposes is prohibited;
  • Deceiving or defrauding other users' accounts to obtain their confidential password is prohibited;
  • It is forbidden to create user accounts under false pretenses;
  • Any activity that violates the Terms of Use is prohibited;
  • You cannot give false information to MechaSharks;
  • You cannot use our data to contact other users to present false promotions and campaigns;
  • Do not use bots, crawlers, scripts and other similar automated means not authorized by us to access the Site, it is forbidden to extract data or functionality from the Service;

Any use of the Services by the Site and any data presented in the User Information provided is at your own risk. MechaSharks will not assume any responsibility for User Information entered on the Site. You retain the rights to any information submitted and displayed on the Services.

All your User information on the Services, you are giving us a worldwide, non-exclusive, royalty-free license to use, copy, modify and display any text or anything you submit or post on the Services or through tools at (“ User Information”) for our lawful business purposes, such as promoting and encouraging improvements to our Services.

7. Miscellaneous

Pursuant to these TERMS OF USE, PRIVACY POLICY, RISK DISCLOSURE, Smart Contracts, or in connection with the Site and Services, all operating rules posted by us constitute the entire agreement between you and MechaSharks regarding your access to and use of the Services and Content. You understand that we will not be liable for any loss, failure, delay or damage caused by any cause beyond our reasonable regular control. You waive any and all defenses you may have based on the electronic form of these Terms of Use and failure to sign.
